FIVEplat Marketplace terms of use

1. Who we are and what the marketplace is

FIVEplat Marketplace (marketplace.fiveplat.es) is a platform of AGILE DIGITAL SOLUTIONS, S.L. («AGDS»), Spanish tax ID B72527815, registered office at Calle Valle de Enmedio 2, Escalera E, Piso 1C, Madrid (Spain), registered in the Madrid Companies Register, Volume 44068, Folio 128, Sheet M-777335. It puts people who need to move vehicles (individuals and companies, «customers») in touch with vehicle transport companies («carriers»).

By creating an account you accept these terms. If you do not agree with them, do not sign up.

2. Who can sign up

• Individuals of legal age who want to move their own vehicles.
• Customer companies that need to move vehicles, through a person authorised to represent them.
• Carriers: companies holding a valid transport licence for the activity they offer.

Sign-up details must be true and up to date. If they change, update them in your account.

3. Sign-up and approval

Individual accounts are active as soon as you sign up. A person at AGDS reviews customer company and carrier accounts before activating them, and we may ask you for documents (for example, the transport licence). We may turn down a sign-up that does not meet these terms.

Approval of an account does not guarantee any minimum number of requests, quotes or awarded moves.

4. Accounts and roles

Each account has one role: individual, customer company or carrier. The role sets what you can do: publish and award requests, or quote.

Your credentials are personal. You are responsible for what is done with your account and must tell us as soon as you learn of any unauthorised use.

5. Requests, quotes and awarding

• The customer publishes a request with the details needed to quote: origin, destination, dates and vehicles.
• Carriers quote. Quotes are blind: no carrier sees the others' offers.
• The customer picks a quote and awards the move. Until then, neither the customer nor the carriers receive each other's contact details.
• On award, the customer and the winning carrier receive the details needed to carry out the move and are bound by the conditions of the accepted quote.

6. AGDS is an intermediary, not a carrier

AGDS brings customers and carriers together and provides the tools to manage the move. It is not a carrier and does not provide the transport service. The transport is carried out by the winning carrier, who is liable for it under the applicable transport law, including for damage, loss and delay.

7. Users' obligations

• Customers: describe the vehicles and the conditions of the move accurately, and have the vehicles ready at the agreed place and date.
• Carriers: hold the licences and insurance their activity requires, and carry out the move under the conditions of the accepted quote, with the mandatory documents.
• Everyone: do not publish false data, do not impersonate anyone, do not use the platform for unlawful purposes and do not extract its data by automated means.

8. Ratings

After each move, customer and carrier can rate each other. Ratings must refer to a real move and be honest. AGDS may remove ratings that are false, offensive or unrelated to the move.

9. Financial terms

Financial terms are agreed with each company.

10. AGDS's liability

AGDS takes reasonable steps to keep the platform running continuously and securely, but cannot guarantee there will be no interruptions, for example for maintenance or because of third-party failures.

AGDS reviews companies before activating them, but is not liable for the accuracy of the data each user publishes or for the performance of the transport. Nothing in these terms limits liability that the law does not allow to be limited, or the rights the law grants to consumers.

11. Intellectual property

The platform, its software and its content belong to AGDS or its licensors. Users keep their data and authorise AGDS to use it as far as needed to provide the service.

12. Closing and suspension

You can close your account at any time on the platform or by writing to clientes@agdigitals.com. Moves already awarded must be completed.

AGDS may suspend or close an account that breaches these terms, gives false data or is used fraudulently. Where possible, we will warn you first and explain why.

13. Data protection

How the marketplace processes personal data is explained in the FIVEplat Marketplace privacy policy.

14. Changes to these terms

If we change these terms we will tell you on the platform or by email at least fifteen days before they apply. If you do not agree, you can close your account before that date.

15. Governing law and jurisdiction

These terms are governed by Spanish law. Disputes are submitted to the courts of Madrid, unless the user is a consumer, in which case the courts of their place of residence have jurisdiction.
